CITY OF PRINCETON ORDINANCE NUMBER 321

 

ORDINANCE AMENDING THE PRINCETON CITY UNIFIED ZONING ORDINANCE WITH RESPECT TO DISTRICT CHANGES AND ORDINANCE AMENDMENTS, MAP REPLACEMENT AND ZONING OF ANNEXED AREAS

 

BE IT ORDAINED by the City Council of the City of Princeton, Iowa

 

AN ACT to amend Article No. VI, 6.1 AND Article XXXII, 32.2 of the Unified Zoning Ordinance for the City of Princeton, Iowa, adopted August 9, 2011, and amendments thereto, to:

 

 

 

BE IT ENACTED,

 

ARTICLE VI

 

6.1       Changes and Amendments.

The Council may on its own or on petition and public hearing as provided by law, and after report by the Commission, amend, supplement or change the boundaries or regulations herein or subsequently established.

Step 1. Any owner or owners of property may present a petition duly signed and verified, requesting an amendment, supplement or change in the regulations prescribed for a district or part thereof. Such petition shall be signed by the owners of at least 50 (50) percent of the area included in such proposed change and by the owners of fifty (50) percent of the properties within three hundred (300) feet and said petition shall be filed with the Commission.

Step 2. The Commission shall make a report to the Council within sixty (60) days from the date of receipt of such petition. Upon the Commissionís report the Council will set a date for a public hearing and a written notice of this hearing shall be provided to the surrounding properties within five hundred (500) feet twenty (20) business days prior to the Councils public hearing on such amendments, supplements or changes.

In  case the proposed amendment, supplement or change be disapproved by the Commission, or in case of a protest against any proposed amendment, supplement or change signed by the owners of twenty (20) percent or more, either the area of the lots included in such proposed change, or those immediately adjacent in the rear thereof, extending the depth of one (1) lot or not to exceed two hundred (200) feet there from, or those directly opposite thereto, extending the depth of one (1) lot not to exceed two hundred (200) feet there from, or those directly opposite thereto, extending the depth of one (1) lot or not to exceed two hundred (200) feet from the street frontage of such opposite lots, such amendment shall not become effective except by the favorable vote of at least three-fourths (3/4) of all members of Council.

 

 

 

 

 

 

ARTICLE XXXII

 

32.2     Fees Set by Council Resolution

 

$100 for the first five acres

$2 for each whole acre over five acre

 

All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.

 

If any section, subsection, sentence, clause, or phrase of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, subsection, sentence, clause, or phrase hereof not adjudged invalid or unconstitutional.

 

This ordinance shall become effective upon publication as required by law.
